Venue Transfer
In Missouri, “venue” refers to the county in which a suit is filed or should be filed. There are certain rules dictating where certain types of cases should be filed. There are separate rules stating when cases may be transferred to another venue/county.
Under Rule 51.03, for instance, a party can be granted a change of venue automatically if certain conditions are met: (1) the venue/county in which the action is pending has a population of less than 75,000, (2) the case is triable to a jury and (3) the request is made in a timely fashion (i.e., no later than 10 days after an answer is due to be filed).
