Suit on Open Account
A suit on open account is a type of collections lawsuit. It is basd in contract. To prove a suit on open account, the plaintiff needs to show an offer, an acceptance, consideration between the parties, correctness of the account and the reasonableness of the charges. J.D. Streett & Co. v. Bone, 334 S.W.2d 5, 8 (Mo. 1960). By way of example, and in the context of merchandise, a plaintiff must show that the (1) defendant requested that plaintiff furnish the merchandise, (2) the defendant furnished the goods and the (3) charges were reasonable.
